4. CHOICES ABOUT COOKIES

A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a web site's computers and stored on your computer's hard drive. Any web site can send its own cookie to your browser if your browser's preferences allow it, but in order to protect your privacy, your browser only permits a web site to access the cookies it has already sent to you, not the cookies sent to you by other sites.

  • You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. (Each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences.)
  • The Adobe Flash Player is a powerful application and web tool that allows rapid development of highly dynamic content. Flash (and similar applications) use technology to remember settings, preferences and usage similar to browser cookies but these are managed through a different interface than the one provided by your web browser. Varolii employs Adobe Flash Cookies in certain situations where we use Flash to provide special content such as video clips or animation. You can access your Flash management tools from Adobe's web site directly.
  • If you reject all cookies, you will not be able to use Varolii products or services that require you to "sign in" and you may not be able to take full advantage of all Services and related offerings. However, many Varolii Services do not require that you accept cookies.

5. VAROLII'S PRACTICES REGARDING COOKIES

Varolii uses cookies, and cookies of third parties, for a number of purposes, including but not limited to:

  • Accessing your information when you "sign in" so we can provide you with customized content or remember the last page you visited on the Site;
  • Delivering content relevant to your interests when you visit the Site, using a cookie that gathers anonymous information based on visits to the Site;
  • Collecting general internal and customer analytics; and
  • Conduct research to improve Varolii's content, products and services.

If you would rather not receive customized content off of the branded Varolii Site, you can opt-out of this service by following the Choices about Cookies instructions, above.

6. INFORMATION SHARING

Varolii may share your personal information with third parties in the following limited circumstances:

  • As set forth in this Privacy Policy;
  • We have received your consent (we require express consent for the sharing of any sensitive personal information);
  • To our subsidiaries, affiliated companies or other third parties for the purpose of processing personal information on our behalf;
  • To our insurers, auditors, and attorneys, on a need-to-know basis;
  • In the event of a merger, acquisition, debt financing, or any form of sale of all or part of company assets or other event in which personally identifiable information could be transferred to third parties as part of our company’s business assets.

We require that third parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

In addition, we may share personal information to access, use, preserve or disclose such personal information as reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable terms of service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Varolii, its users or the public as required or permitted by law.

7. INFORMATION SECURITY

Varolii takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

Except as set forth in this Privacy Policy, we restrict access to personal information to Varolii employees, contractors and agents who need to know that information based on defined business requirement. These individuals are bound by non-disclosure agreements and may be subject to discipline, including termination if they fail to meet these obligations.

If you are visiting or using the Site from outside of the United States, please be advised that our Privacy Policy is intended to meet the laws and regulations of the United States and where applicable, Varolii adheres to the US Safe Harbor Privacy Principles of Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement, and is registered with the U.S. Department of Commerce’s Safe Harbor Program. Varolii’s Safe Harbor Program is addressed in this document.

8. DATA INTEGRITY

Varolii processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable legal requirement. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services or as otherwise permitted under this Privacy Policy. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

9. ACCESSING AND UPDATING PERSONAL INFORMATION

When you use the Services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Some of our services have different procedures to access, correct or delete users’ personal information. We provide the details for these procedures in the specific privacy notices or FAQs for these services.

10. ENFORCEMENT

Varolii regularly reviews its compliance with this Privacy Policy. When we receive formal written complaints at this address, it is Varolii’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Varolii and an individual.

11. CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify our Privacy Policy at any time. If we decide to materially change our Privacy Policy, we will post those changes on this Site, so you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. We encourage you to review this Privacy Policy each time you visit our Site to see if it has been updated since your last visit and to make sure you understand how information you provide will be used.

If you have any additional questions or concerns about this Privacy Policy, please feel free to contact us any time through this Site.
